The notary is a public officer whose presence is mandatory when signing a deed of sale or mortgage in Quebec. They verify the titles, ensure the legal validity of the transaction, draft the authentic deed, and handle its publication in the land registry. They protect the interests of all parties simultaneously.
You will generally need to provide: valid identification, your social insurance number, the signed promise to purchase, your financial institution's contact information if you have a mortgage loan, and any documents relating to the co-ownership if applicable (bylaws, administrator's certificate, etc.).
Signing a deed of sale generally takes between 45 and 90 minutes. The notary will explain each clause to you before proceeding. For a mortgage refinancing, the meeting is often shorter (30 to 45 minutes). An electronic signature can be arranged if you are unable to travel.
Divided co-ownership (condominium) involves exclusive ownership of part of the building with a separate property title and common areas managed collectively. Undivided co-ownership means that several people jointly own the same property, with rights defined by an indivision agreement.
